Harriet Miers doesn’t have the experience to be Supreme Court Justice

Looking at her record, one has to wonder why President Bush picked her to be the Supreme Court nominee.  After all, she only had 27 years of experience as a lawyer, including courtroom experience, and served as president of both the Dallas Bar Association and the State Bar of Texas.  Miers also clerked for the Chief Judge of the United States District Court for the Northern District of Texas.  She was named one of the 50 Most Influential Women Lawyers in America and one of the 100 Most Influential Lawyers in America by the National Law Journal.  We didn’t know much about her personal views, other than her support for civil rights for homosexuals.

Oh, I’m sorry, isn’t this article supposed to be about Hariet Miers?  Elena Kagan?  Who’s she?

As we know, the Democrats cried that Harriet Miers didn’t have experience and not enough was known about her, therefore she didn’t qualify as a nominee for the United States Supreme Court. 

So who is Elena Kagan and what is her experience?

Kagan has almost no courtroom experience, but she did give money to Obama’s campaigns, giving $4600 in contributions in June of 2008, as well as an additional $2000 to support Obama when he ran for the U.S. Senate.  Whoops, that’s not courtroom experience, but I guess you could call it a career investment.

Recently, thousands of documents were released from Kagan’s service in the Clinton White House.  No doubt these were carefully selected documents.  Quantity doesn’t equal quality though, as most of the documents don’t contain a lot of information about who Kagan really is and how she would rule as Supreme Court Justice, just plenty of memos with hints.

Is Kagan a homosexual or an ex-homosexual?  Does that matter?  Considering the fact that Democrats are pushing for all things homosexual, including the overturning of don’t ask don’t tell, yes, it is important.  A CBS blog claimed that Kagan “is known in Harvard circles as a lesbian”.  “In response, the White House blasted CBS for its “lies.”.”


We all know how right-wing and conservative CBS is, right?

Obama said that he was “proud to be the first President to appoint openly LGBT (lesbian, gay, bisexual, transgender) candidates to Senate-confirmed positions in the first 100 days of an Administration.”  Perhaps he’s not so proud of this nominee for the SC?

What do we really know about Elena Kagan and the constitution?

The liberal Huffington Post points to the American Civil Liberties Union who “released a report concluding that Kagan has demonstrated intellect and knowledge of the law but has not weighed in on most constitutional issues.”


Okay, she’s smart, but doesn’t appear to know anything about the constitution.  Wait a minute, what exactly is a Supreme Court Justice supposed to do again?  Oh yeah, DEFEND THE CONSTITUTION!

The ACLU added “The simple truth is that there is much that we do not know about Kagan’s views on the Constitution and the court,” the ACLU’s report said. “The available record offers very few clues about her constitutional views on criminal justice, immigration, voting rights, prisoners’ rights, due process, the Establishment Clause and a host of other recurring Supreme Court topics.”

What did Obama think about Miers?

In 2005, then Senator Obama said “To some degree, the challenge to us is that she’s simply unknown…. Other than the fact that she’s been a great loyalist of the President and she clearly is a good corporate lawyer, we really don’t know much else about her.”

Who’s he talking about, Hariet Miers or Elena Kagan?

Let’s face it, Obama is at the least a hard-core socialist.  Therefore anyone he picks for any position will have to support socialism, abortion and homosexuality.

“In United States v. Stevens, a case Kagan argued this year in front of the Supreme Court as solicitor general, the court said that her argument—which was that free speech should be limited based on the value it has on society—was “startling and dangerous.””

The article continues:

“The court went on to conclude that such limitations on the freedom of speech are not authorized by our Constitution just because “some speech is not worth it.” Justices Kennedy, Ginsburg, Sotomayor, and even Stevens, the justice known to be the most liberal, joined the majority. Once again Kagan was on the wrong side of the mainstream and even disputed by the liberals on the court.”


In my opinion, some of the most important questions we have to ask about Elena Kagan are how she feels about America, about our republic, about capitalism, about the constitution?  I think the end to her 1981 thesis on Socialism gives us a good idea of her views.  Kagan said:

“Through its own internal feuding, then, the SP (Socialist Party) exhausted itself forever and further reduced labor radicalism in New York to the position of marginality and insignificance from which it never recovered.  The story is a sad but also a chastening one for those who, more than half a century after socialism’s decline, still wish to change America.  Radicals have often succumbed to the devastating bane of sectarianism; it is easier, after all, to fight one’s fellows than it is to battle an entrenched and powerful foe.  Yet if the history of local New York shows anything, it is that American radicals cannot afford to become their own worst enemies.  In unity lies their only hope.”

I believe Elena Kagan, like President Obama, want to “change America.”  I believe people like them oppose everything America represents, things like freedom, justice, honor, values, self defense, independence, freedom of speech, the right to bear arms, freedom of religion, and finally, the most important right we have, the right to life, without which we can have none of the others.

Notice the articles I quoted from are from liberal websites and that they seem to oppose Kagan for Supreme Court Justice?  There’s no doubt Republicans should oppose her nomination, but unfortunately they are struggling with backbone issues.  There will be a small show as usual, but most likely Kagan will go through.

It’s simple really.  Republicans just need to ask, if Harriet Miers wasn’t qualified to be a Supreme Court Justice, how does Elena Kagan qualify?
